This Equestrian Rental Agreement (hereinafter “Agreement”) is made and entered into on the date stipulated below (and is valid through December 31, 2021) by and between Westmoreland Davis Memorial Foundation, Inc. (hereinafter “MORVEN PARK”) and the Participant Name provided below (hereinafter “User").
WHEREAS, MORVEN PARK has agreed to confer to USER the non-exclusive possession and use of the facilities identified as (Location on property): 41580 Sunday Morning Lane, Leesburg, VA 20176, subject to the terms of this Agreement, for the purpose of participating in one or more of the following activities: Polo, Dressage, Combined Training, Hunter/Jumper, Foxhunting, Organized Trail Rides, and/or Driving Events.
THEREFORE BE IT AGREED: USER shall be entitled to use the above referenced facilities and participate in the aforementioned horse related activities for each day that a rental fee is paid. This Agreement shall remain valid and binding on USER for a period of one (1) year from the date of execution of this Agreement or until this Agreement is superseded by a new Equestrian Rental Agreement signed by USER, whichever is later.
In exchange for being permitted to participate in the above mentioned horse related activities, the USER, his/her heirs, guardians, and legal representatives, releases, hold harmless, indemnifies and exonerates the Westmoreland Davis Memorial Foundation, Inc., its masters, officers, directors, members, employees, or guests or any landowners, landholders or the persons making Morven Park property available to the USER from any and all liability, loss, cost or expense including reasonable attorneys’ fees rising out of any suit based on any accident or injury, (including death), of the USER and of the USER’s property in or about Morven Park, whether or not caused by the negligence of anyone on Morven Park property arising out of the USER’s participation in the above mentioned horse related activities. The provisions within this document shall survive the expiration of this Agreement.
The USER’s signature hereby indicates his/her agreement to wear a hard hat at all times while riding at Morven Park, to obey all rules set forth by MORVEN PARK in the Rules and Regulations, and allow Morven Park to use this information in mailings. This information will not be sold or shared. I further grant the Released Parties the right to photograph and/or videotape me and/or my child or ward and further to display, use and/or otherwise exploit my and/or my child or ward’s name, face, likeness, voice, and appearance, in all media in all forms including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes, including, without limitation, publication of Event results and standings, without compensation, reservation or limitation.
The following COVID-19 Guidelines must be adhered to when competing and/or attending our competitions. In addition, all Federal, State, and local laws that may be applicable must be followed. Management reserves the right to change the guidelines when/if it is necessary. Failure to follow guidelines may result in expulsion from the show grounds.
The best way to prevent illness is to avoid being exposed to the virus. (see www.cdc.gov) If you plan to come to the competition grounds, you must be able to assure management that neither you, nor anyone in your household:
1. Has tested positive or has been presumed positive for COVID-19 at any time during the past 14 days 2. Has been advised by a healthcare professional to self-quarantine at any time during the past 14 days 3. Has been in close physical contact with someone who has tested positive for COVID-19 or who has been presumed positive for COVID-19, during the past 14 days 4. Is subject to a quarantine order or a recommendation of a healthcare professional that, in either case, would make it inadvisable to attend a public event or competition. 5. Has, within the past 24 hours, exhibited any of the following symptoms: fever of 100.4 or greater, cough, shortness of breath.
Please Note:
Social distancing guidelines must be followed at all times. Current guidelines call for a 6’ minimum spacing between individuals. Do NOT gather in groups. Masks are required at all times and can only be taken off while mounted on a horse. The use of gloves is encouraged, but not required. Avoid touching your eyes, nose, and mouth with unwashed hands. Please frequently clean and disinfect all tack, equipment, and surfaces that others may come in contact with. This includes tack trunks, reins, halters, lead ropes, and other common items that others may come in contact with during event attendance. Please use trash receptacles, so that staff does not have to come in contact with contaminated items that are not discarded properly. DO NOT LITTER! All competitors and attendees are responsible for monitoring their own personal and family health prior too, during, and after attending a competition. Please keep time spent on the competition grounds to a minimum, in order to limit contact and exposure to yourself and other attendees.
